At present, it does appear that (A) President Trump's accusations against President Obama are without merit; and, (B) once Donald Trump became president-elect - and, became eligible to receive secret briefings - that the NSA information gathering began to "unmask" parties (at Trump Tower &/or through electronic systems operated under the "Trump" banner) and, consequently, NSA began to log and to assess those communications for intelligence integrity and security values.

Hence, to date, there is no evident continued right of expression for President Trump to assert that he is somewhat vindicated with the accusations that President Obama breached criminal law - i.e., specifically, had Donald Trump monitored at the Trump Tower, et cetera.
